General Terms and Conditions for Camper Van Rental – VanBreak

These general terms and conditions govern the rental agreement for camper vehicles offered by VanBreak. Any reservation implies full, complete, and unconditional acceptance of these terms and conditions.

1. Payment

The reservation is confirmed after payment of a 50% deposit of the total amount.
The balance is automatically charged 7 days before the departure date to the card used at the time of booking.
In the event of a no-show, the full amount remains due.
Bank fees, exchange rates, and commissions are the responsibility of the customer.
The renter expressly authorizes VanBreak to charge any amounts due (fees, damages, fines, extensions).

2. Booking Modification

Any modification must be requested by email.
Less than 15 days before departure, shortening the rental duration is not permitted or may be subject to additional financial charges.

3. Cancellation

  • > 15 days: credit valid for 12 months
  • Between 15 and 7 days: 50% retained
  • Less than 7 days: 100% due

Cancellation insurance option: free cancellation up to 48 hours before departure with full credit.

4. Documents and Drivers

The renter and all drivers must present a valid driving license and identification.

Minimum age: 25 years old and license held for at least 2 years.

Non-EU licenses: an international driving permit is required.

5. Schedule and Duration

Vehicles are rented per day. Any started day is due.

Minimum duration:
Low season: 3 days
High season: may vary between 4 and 7 days

Check-in: according to defined time slots and VanBreak availability.
Monday: 10:30 – 19:30
Tuesday to Friday: 09:00 – 19:30
Saturday: 09:00 – 18:00
Sunday: Closed, departure possible subject to availability – please contact us

Check-out: the vehicle must be returned no later than 13:00 from Monday to Sunday.

A late return is only possible if the corresponding option has been subscribed to in advance, subject to availability and validation by VanBreak.
Any unauthorized delay will result in a charge of €50 per started hour, without prejudice to any damage suffered by the rental company.
An early return does not entitle to any refund.

6. Check-in / Check-out

  • A full inspection is carried out at departure.
  • The renter has 3 hours to report any unmentioned defect.
  • The vehicle must be returned:
    • with the same fuel level
    • clean water tank filled
    • wastewater tank emptied
    • toilets emptied and cleaned
    • clean and tidy, dishes done, sheets removed and stored in the trunk
  • The renter undertakes to declare any incident and complete the check-out form before returning the keys of the van

Fees will be applied in case of non-compliance.

7. Renter’s Responsibility and Insurance

The renter is responsible for any damage occurring during the rental period, unless proven otherwise.

  • Not covered:
    • unpaved roads
    • fuel error / AdBlue
    • interior damages
    • awning, roof and pop-up roof fabric, interior accessories (table, bench, furniture, non-exhaustive list), underbody and lower parts of the vehicle

Claim management fees are a minimum of €59.
The renter is responsible in case of negligence, gross fault, or improper use.

8. Lessor’s Responsibility

The lessor’s liability is limited to cases of serious negligence in accordance with Spanish law.
In case of unavailability, an equivalent vehicle will be provided (same category) or refunded.

Cat. A: Benimar motorhome
Cat. B: Sunlight van, Burstner Campeo, Burstner B66, Burstner Papillon, VW Grand California, Benimar van
Cat. V: VW California Ocean, Beach, Renault Handroad, Caddy

The lessor’s liability is strictly limited to cases of intentional fault or serious negligence, in accordance with Spanish legislation.

  • loss of enjoyment, holidays or business
  • indirect or consequential damages
  • delays, breakdowns or unavailability beyond its control

In case of vehicle unavailability, the lessor undertakes to provide an equivalent vehicle or refund the amounts paid, without any additional compensation.

In the event of a breakdown, accident, or immobilization of the vehicle during the rental period, no refund will be due, except in the case of a proven initial defect.

The lessor shall not be held responsible for personal belongings left inside the vehicle.

9. Insurance Packages

Three packages: Basic (included in the daily rental price), Premium, and Complete with different levels of coverage.

Insurance Packages and Liability Limitation

The renter may reduce their financial liability by subscribing to a PREMIUM or COMPLETE insurance package, in accordance with Article 7.

The BASIC package is included by default in every booking and includes:

  • Comprehensive insurance (theft, fire) with a €1,500 deductible
  • 24/7 roadside assistance in Spain
  • Driving limited to Spanish territory
  • 2 authorized drivers
  • Unlimited mileage

🔹 PREMIUM Package

  • Deductible reduced to €750
  • Authorized travel in Spain and Portugal
  • 3 authorized drivers
  • Glass breakage coverage (excluding headlights, lights, and mirrors)
  • Assistance in case of accidental puncture
  • Coverage for minor scratches (≤ 3 cm, without dent)

🔹 COMPLETE Package

  • Deductible reduced to €450
  • 4 authorized drivers
  • Coverage for minor scratches on bodywork and mirrors
  • Water pump coverage

⚠️ Limits and Exclusions of Coverage (essential clause)

  • Damage resulting from misuse or non-compliant use of the vehicle
  • Damage caused on unauthorized roads or unsuitable terrain
  • Damage to lower parts, upper parts, roof or awning
  • Interior and accessory damage
  • Fuel errors or improper handling

In these cases, the renter is fully liable for the total amount of repairs, without limitation of deductible.

⚠️ Specific Cases

Glass breakage

Covered only from the PREMIUM package (excluding headlights, lights, and mirrors).

Puncture

Covered only if accidental.
In case of negligence (terrain, pressure, improper driving): 100% at the renter’s expense.

Scratches

  • ≤ 3 cm: covered depending on the package
  • > 3 cm or with dent: at the renter’s expense

Vehicle damaged in parking

A police report is mandatory.
Otherwise: full responsibility of the renter.

Vehicle interior

Always at the renter’s expense (not covered).

Travel outside territory (Portugal)

  • Billing of PREMIUM daily rate × total number of days
  • Management fees up to €100

Misuse

  • Improper use
  • Negligence
  • Failure to comply with contractual conditions

Leads to full liability of the renter, without limitation or insurance coverage.
